The Commonwealth Director of Public Prosecutions received from the Australian Federal Police a brief of evidence in relation to the creation and use of documents in support of accusations made by Senator William Daniel Heffernan against a sitting Judge of the High Court of Australia.
These documents were allegedly supplied to the Senator by Mr Wayne Patterson, a former Comcar driver and have been found to be not copies of genuine documents.
Following an assessment of the brief of evidence and applying the Prosecution Policy of the Commonwealth a decision has been made that there is insufficient cogent evidence to establish the requisite criminal standard that any person has prima facie committed a criminal offence.
